These terms control this auction in all regards and supersede all previous announcements, advertisements and published information, however distributed, except any announcement made by Auctioneer at the auction which will take precedence and be controlling in all instances.
Auctioneer has been hired by the Sellers, including a Chapter 7 U.S. Trustee for the Bankruptcy Court, District of Kansas, to act as Sellers’ agent in conducting the auction, and Auctioneer is not serving as an agent for the Bidder or any Buyer.
Payment is due for all items on the date of the sale. Out-of-state checks not accepted unless previously approved by the Auctioneer and accompanied by a bank letter of credit. Buyers will be allowed until 5:00 PM, March 23, 2010, to remove items purchased; however no purchases may be moved until payment is received and buyer assumes responsibility for any and all theft or damage to items purchased subsequent to purchase and until removed from the premises.
Auctioneer reserves the right to withdraw any lot or portion of a lot from the auction or to cancel the entire auction without notice or liability to Auctioneer or Sellers.
Each lot will be sold AS IS, WHERE IS with all defects and faults, and no warranties or guarantees of any kind will be given by the Sellers or auctioneer, including no warranty of fitness, merchantability, or suitability. Bidders should carefully inspect each lot to determine condition and contents. Bidder acknowledges that all lots were available for inspection prior to the auction and that Bidder is relying solely on Bidder’s own inspection of the lots and not on any information listed in the catalog or otherwise provided by Auctioneer, the auction staff or the Sellers.

NO REFUNDS WILL BE MADE FOR ANY REASON.
Persons attending the auction understand that the auction and site may pose both obvious and hidden dangers, defects and other perils, and each person assumes the risk of all injury, loss and/or death from any cause whatsoever, and Auctioneer and Seller will have no liability whatsoever. Bidder agrees to indemnify Auctioneer and Seller and to hold them harmless for any injury, death or other damage to person or property at the auction site, which was caused by Bidder.

Registering to bid or attending the auction indicates full understanding and acceptance of these terms, along with the agreement to be so bound.
